Terms of Use
The Nuclear Waste Management Organization (“NWMO”) wants Canadians
to become involved in helping to shape its study of approaches to
managing nuclear fuel waste. The NWMO hopes to encourage dialogue and
collaboration with Canadians and invites you to actively participate by
visiting and interacting with the NWMO Web Site (the “Site”).
These Terms of Use, together with NWMO’s Privacy Policy,
constitute the entire agreement between you and NWMO relating to your
access to and use of the Site. NWMO may revise these Terms of Use at
any time without prior notice. By using this Site, including use of
this Site following any modification of these terms, you accept these
terms and conditions. If you do not agree to these Terms of Use, please
do not access or use this Site. NWMO recommends that you review these
Terms of Use each time you access the Site.
1. Use of the Site
You may access and use
the Site for your personal, non-commercial use, provided that you do so
only in accordance with these Terms of Use.
2. Use of Forums
The Site may contain
forums, bulletin board services, panels, chatrooms, polls, surveys,
news groups, or other such communication services (collectively,
“Forums”) designed to enable you to communicate and interact with NWMO
and/or other members of the public. You agree that while using the
Site or participating in any Forums available on the Site you will not
do any of the following:
a) Upload, post, transmit, publish or distribute any material or information
i. For which you do not have all necessary rights and licenses;
ii. That is inappropriate, obscene, derogatory, defamatory or offensive;
iii. That
contains a computer virus or other code file or program which could
disrupt or interfere with the functioning of the Site; or
iv. That constitutes, or encourages conduct that would constitute, a criminal offense or give rise to civil liability.
b) Use the Site in such a manner as to gain or attempt to gain
unauthorized entry or access to the computer systems or networks of
others,
c) Collect information about other users, including e-mail addresses, without their consent,
d) Forge
headers or in any manner manipulate identifiers in order to disguise
your origin or impersonate any person or other entity, or
e) Use the Site or any Forums in a manner which is contrary to law or to generally accepted Internet principles.
3. Submitted Information
Subject to
NWMO’s Privacy Policy, any material or information that you post,
input, upload, provide, submit or transmit to the Site or to NWMO
through email, the World Wide Web or in any other manner (the
“Submitted Information”) will be treated as non-confidential
information You assume full responsibility and liability for any
Submitted Information and represent and warrant that you have all
necessary rights and licenses with respect to the Submitted
Information. You hereby grant NWMO and other Site users a royalty-free,
perpetual, non-exclusive, irrevocable license to use, modify, copy,
publish and communicate to the public by means of telecommunication,
and distribute the Submitted Information or any derivative of such
information. Private correspondence to NWMO is not considered Submitted
Information and is treated on a confidential basis. Any contact
through the NWMO’s “Contact Us” form is considered private
correspondence for this purpose. NWMO does not control any Submitted
Information, therefore, you should not consider any such information to
be screened, approved or endorsed by NWMO. It is recommended that users
exercise caution when providing personally identifying information in
any Forum or otherwise. While it has no obligation to do so, NWMO
reserves the right to monitor the Site and Forums from time to time and
to edit, refuse to post or remove any information or materials that, in
its view, do not adhere to these Terms of Use.
4. Ownership of Site and Content
The
Site and all written and other materials made available through the
Site, excluding Submitted Information, (the “Content”) is the property
of NWMO and/or its licensors and is protected by copyright, trade-mark
and other laws. Certain names, logos, graphics, designs or other
Content in the Site are trade names or trade-marks owned by or licensed
to NWMO. Without prejudice to the rights of third party licensors and copyright owners, other than NWMO, who have so marked their material and to the extent permitted by law, the NWMO hereby grants you permission to copy, distribute, download, and/or transmit single copies of items comprising NWMO Content for your personal, non-commercial use for research, review, criticism or private study, provided that you maintain all copyright and other notices contained in such Content, and provided that such permission does not include the right to reproduce the Site as a whole (or a substantial part thereof). No other right or license to the Site or the Content is hereby granted.
The reports and papers which NWMO has commissioned through third
parties, and which appear on this website, do not necessarily reflect
the views or position of the Nuclear Waste Management Organization
(NWMO) and, unless otherwise specifically stated, are made available to
the public by NWMO for information only. The contents of these reports
and papers reflect the views of the author(s) who are solely
responsible for the text and its conclusions as well as the accuracy of
any data used in its creation. Neither NWMO nor any employee makes any
warranty, express or implied, or assume any legal liability or
responsibility for the accuracy, completeness, or usefulness of any
information disclosed, or represents that the use of any information
would not infringe privately owned rights. Any reference to a specific
commercial product, process, service by trade name, trademark,
manufacturer, or otherwise, does not constitute or imply its
endorsement, recommendation, or preference by NWMO.
5. Third-Party Links
For your
convenience, NWMO may provide links to websites that are owned or
operated by third parties. Such sites are independent from NWMO and
NWMO has no control over the content of such third-party sites. A link
to a third-party’s site does not imply that NWMO endorses the site,
approves the contents of the site or guarantees the accuracy or
timeliness of such third-party information. It is your responsibility
to ensure that you review the terms and conditions applicable to such
third-party site before using it.
6. Disclaimer and Limitation of Liability
The
Site and the Content are provided on an “as is” and “as available”
basis. While NWMO attempts to provide information that is correct,
accurate, current and timely, NWMO makes no representations, conditions
or warranties either express or implied, that (i) the Site or Content
will be accurate, current or reliable; (ii) that the operation of the
Site will be uninterrupted or error-free, or (iii) that the Site will
be free from viruses or harmful components. NWMO hereby disclaims any
warranties or conditions arising by law, statute, trade usage or
otherwise, including without limitation warranties and conditions of
merchantability, fitness for a particular purpose, non-infringement or
title. In no event will NWMO, its directors, officers, employees,
agents or licensors be liable to you or any third party for damages of
any kind incurred in connection with your use of the Site.
7. Indemnity
You agree to defend,
indemnify and hold NWMO, its affiliates, directors, officers,
employees, agents and licensors harmless from any and all liabilities,
costs and expenses related to any violation of these Terms of Use by
you or in connection with your use of this Site and the Contents, your
violation of these Terms of Use, your violation of a third party’s
rights or your Submitted Information.
8. Governing Law
These Terms of Use and
any issue or dispute relating to this Site shall be governed by and be
construed in accordance with the laws of the Province of Ontario and
the applicable laws of Canada. By using this Site you agree to submit
to the exclusive jurisdiction of the courts of the Province of Ontario.
9. General Provisions
Failure by NWMO to
insist upon or enforce strict performance of any provision of these
Terms of Use or of the Privacy Policy shall not be construed as a
waiver of any provision or right. If any of the provisions of these
Terms of Use are deemed to be void, invalid or otherwise unenforceable
by a court of competent jurisdiction, such determination shall not
affect the remaining provisions contained herein. This section and
sections 6, 7 and 8 will survive any termination of this agreement.
