Terms of use

    The Nuclear Waste Management Organization (“NWMO”, “we”, “us” or “our”) wants Canadians to be informed and updated on our activities relating to the management and implementation of Canada’s plan for safe, long-term management of used nuclear fuel. The NWMO hopes to encourage dialogue and collaboration with Canadians, and invites you to actively participate by visiting and interacting with our NWMO website at www.nwmo.ca (the “Site”).

    These Terms of Use, together with the NWMO’s Privacy Policy, constitute the entire agreement between you and the NWMO relating to your access to and use of the Site. We may revise these Terms of Use at any time without prior notice and will post the revised Terms of Use on this webpage. By using this Site, including use of this Site following any modification of these terms, you acknowledge that you accept these terms and conditions. If you do not agree to these Terms of Use, please do not access or use this Site. The NWMO recommends that you review these Terms of Use each time you access the Site.

    1. Use of the Site

    You may access and use the Site for your personal, non-commercial use, provided that you do so only in accordance with these Terms of Use and pursuant to the applicable laws in your jurisdiction of residence.

    Nothing in these Terms of Use shall be deemed to affect any statutory rights that you may have under local laws which cannot be or have not been altered, limited or waived by these Terms of Use.

    2. Acceptable Use Policy

    We at the NWMO want to foster a safe and respectful community. As a result, you agree that while using the Site, you will not do any of the following:

    a. Upload, post, transmit, publish or distribute any material or information;

    i. For which you do not have all necessary rights and licences;

    ii. That is inappropriate, obscene, derogatory, defamatory or offensive;

    iii. That contains a computer virus or other code file or program which could disrupt or interfere with the functioning of the Site; or

    iv. That constitutes, or encourages conduct that would constitute, a criminal offence or give rise to civil liability.

    b. Use the Site in such a manner as to gain or attempt to gain unauthorized entry or access to the computer systems or networks of others;

    c. Collect information about other users, including personal information such as email addresses, without their consent;

    d. Forge headers or in any manner manipulate identifiers in order to disguise your origin or impersonate any person or other entity;

    e. Send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation through our Site; or

    f. Use the Site in a manner which is contrary to law or to generally accepted Internet principles.

    3. Submitted Information

    Our Site allows you to contact us and provide, submit or transmit your comments, documents or other materials (“Submitted Information”) to NWMO through our Contact Us page. For example, you may send us general or media inquiries, submit your comments relating to our Implementation Plan, or provide feedback about our work. At your request, we will publish your Submitted Information to the appropriate section of our Submissions Library. We may also summarize and include certain Submitted Information in our publications relating to the Implementation Plan.

    All Submitted Information is handled in accordance with NWMO’s Privacy Policy. By sending us Submitted Information, you assume full responsibility and liability for any Submitted Information and represent and warrant that you have all necessary rights and licences with respect to the Submitted Information. You hereby grant the NWMO and other Site users (to the extent you request the Submitted Material be made public on the NWMO site or otherwise) a royalty-free, perpetual, non-exclusive, irrevocable licence to use, modify, copy, publish and communicate to the public by means of telecommunication, and distribute the Submitted Information or any derivative of such information.

    Please note that the NWMO does not edit the content of any Submitted Information; therefore, you should not consider any such information to be screened, approved or endorsed by the NWMO.

    It is recommended that users exercise caution when providing personal or sensitive information through our Site or otherwise. While it has no obligation to do so, the NWMO reserves the right to monitor the Site from time to time and to edit, refuse to post or remove any information or materials that, in its view, do not adhere to these Terms of Use. In addition, NWMO shall not be liable or responsible to any person or entity for the performance or non-performance of the monitoring, recording, editing or removal activities mentioned above.

    4. Ownership of Site and Content

    The Site and all written and other materials made available through the Site, including but not limited to text, graphics, images, music, software, audio, video, concepts, methods of operation, works of authorship of any kind, and information or other materials appearing on or emanating to and/or from the Site, as well as their overall design and appearance, but excluding Submitted Information, (collectively, the “Content”) is the property of the NWMO and/or its licensors and is protected by copyright, trademark and other laws. Certain names, logos, graphics, designs or other Content in the Site are trade names or trademarks owned by or licenced to the NWMO. Without prejudice to the rights of third-party licensors and copyright owners, other than the NWMO, who have so marked their material and to the extent permitted by law, the NWMO hereby grants you permission to copy, distribute, download, and/or transmit single copies of items comprising the NWMO Content for your personal, non-commercial use for research, review, criticism or private study, provided that you maintain all copyright and other notices contained in such Content, and provided that such permission does not include the right to reproduce the Site as a whole (or a substantial part thereof). No other right or licence to the Site or the Content is hereby granted.

    The reports and papers which the NWMO has commissioned through third parties, and which appear on this website, do not necessarily reflect the views or position of the NWMO, and unless otherwise specifically stated, are made available to the public by the NWMO for information only. The contents of these reports and papers reflect the views of the author(s) who are solely responsible for the text and its conclusions, as well as the accuracy of any data used in its creation. Neither the NWMO nor any employee makes any warranty, expressed or implied, or assumes any legal liability or responsibility for the accuracy, completeness, or usefulness of any information disclosed, or represents that the use of any information would not infringe privately owned rights. Any reference to a specific commercial product, process, service by trade name, trademark, manufacturer, or otherwise, does not constitute or imply its endorsement, recommendation, or preference by the NWMO.

    All trademarks, service marks, trade names, logos and graphics (“Marks”) used on the Site are registered or common law trademarks of NWMO or its licensors and are protected by laws in Canada and internationally, unless otherwise indicated. You may not make any use of any Marks without the prior written consent of NWMO or its licensors.

    5. Feedback on Our Site and Communications

    We at NWMO want to hear from you and welcome any feedback, comments and suggestions you might have, whether it be to improve our Site or communications (“Feedback”). When you submit your Feedback to us, you grant us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sub-licensable and transferable license (under any and all intellectual property rights that you own or control) to use, copy, modify, create derivative works based upon and otherwise exploit the Feedback for any purpose, subject to our Privacy Policy.

    6. Third-Party Links

    For your convenience, the NWMO may provide links to websites that are owned or operated by third parties. Such sites are independent from the NWMO, and the NWMO has no control over the content of such third-party sites. A link to a third-party’s site does not imply that the NWMO endorses the site, approves the contents of the site or guarantees the accuracy or timeliness of such third-party information. It is your responsibility to ensure that you review the terms and conditions applicable to such third-party site before using it.

    7. Disclaimer and Limitation of Liability

    The Site and the Content are provided on an “as is” and “as available” basis. While the NWMO attempts to provide information that is correct, accurate, current and timely, the NWMO makes no representations, conditions or warranties either expressed or implied, that (i) the Site or Content will be accurate, current or reliable; (ii) the operation of the Site will be uninterrupted or error-free, or (iii) the Site will be free from viruses or harmful components. The NWMO hereby disclaims any warranties or conditions arising by law, statute, trade usage or otherwise, including without limitation, warranties and conditions of merchantability, fitness for a particular purpose, non-infringement or title. In no event will the NWMO, its directors, officers, employees, agents or licensors be liable to you or any third party for damages of any kind incurred in connection with your access, use of, or inability to use the Site.

    Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages so the above limitations or exclusions may not apply to you.

    8. Indemnity

    You agree to defend, indemnify and hold the NWMO, its affiliates, directors, officers, employees, agents and licensors harmless from any and all liabilities, costs and expenses related to any violation of these Terms of Use by you or in connection with your access or use of this Site and the Contents, your violation of a third party’s rights or your Submitted Information.

    9. Governing Law

    These Terms of Use and any issue or dispute relating to this Site shall be governed by and be construed in accordance with the laws of the Province of Ontario and the applicable laws of Canada. By using this Site, you agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario.

    10. General Provisions

    Failure by the NWMO to insist upon or enforce strict performance of any provision of these Terms of Use or of the Privacy Policy shall not be construed as a waiver of any provision or right. If any of the provisions of these Terms of Use are deemed to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein. This section and sections 7, 8 and 9 will survive any termination of this agreement.

    In addition to any other rights and remedies available to us, we reserve the right to terminate or suspend your right to access or use our Site, without notice, if we believe, in our sole discretion, that you have violated these Terms of Use.
